Simon Buchen practices predominantly in the criminal law and related areas, including defending and prosecuting serious indictable matters across the full range of Commonwealth and State offences. He regularly appears in summary hearings, jury trials and appeal hearings. Simon Buchen has a special interest in complex federal criminal cases, including Corporations Act and serious taxation fraud offences. He conducts appellate work in the High Court (as junior counsel), Court of Criminal Appeal and District Court.

Cases of note

  • Appeared for the appellant in his successful appeal against a murder conviction. The appellant was acquitted of murder in the Court of Criminal Appeal:  Penza and Di Maria v Regina [2013] NSWCCA 21

  • Appeared for the appellant in his successful appeal to the High Court against a conviction for murder: Cooper v The Queen (2012) 87 ALJR 32; [2012] HCA 50

  • Appeared as a Crown prosecutor in the trial of Mark Standen, the former assistant director of the NSW Crime Commission, for serious narcotic offences: Standen v Commonwealth DPP [2011] NSWCCA 187;  R v Standen [2011] NSWSC 1422

  • Appeared for the defence in a significant insider trading matter: Hartman v R [2011]  NSWCCA 261; R v Hartman (2010) 81 ACSR 121; [2010] NSWSC 1422

  • Appeared for the defence in a significant and long-running pharmaceutical prosecution brought by the Commonwealth DPP, the Therapeutic Goods Administration and ASIC (conducted in the NSW Court of Criminal Appeal, Supreme, District and Local Courts), including: R v JS (2007) 230 FLR 276; 175 A Crim R 108;  R v Selim [2007] NSWSC 362

  • Appeared for the appellant in the Court of Criminal Appeal: Giles v DPP (NSW) (2009) 198 A Crim R 395
