Philip is a Senior Counsel at Forbes Chambers. Maintaining a diverse national practice, Philip practices principally in New South Wales. With considerable experience in judge-only and jury trials and appeals, Philip regularly appears in the Court of Criminal Appeal, as well as the Supreme, District and Local Courts of New South Wales, and administrative tribunals. He has also appeared in the High Court of Australia.

Having appeared in a number of high profile trials, Philip has considerable experience, and has developed specialist knowledge and expertise in a broad range of areas, including criminal law, corporate crime, administrative law, disciplinary proceedings, Commissions of inquiry and inquests, and Work, Health and Safety prosecutions,.  Other areas of particular interest include discrimination law and human rights law.

  • Appearing for defendants in over 100 jury trials in New South Wales and the Northern Territory

  • Appearing on behalf of appellants and respondents in the Court of Criminal Appeal in NSW in over 100 cases in Crown appeals and appeals of convictions and sentences, as well as interlocutory applications

  • Appearing for the Crown Prosecutor for the Commonwealth and New South Wales Director of Public Prosecutions in New South Wales and the Northern Territory

  • Appearing on behalf of accused persons in complex tax fraud trials and appeals, and in relation to other white-collar crimes, including money laundering and insider trading

  • Acting on behalf of accused persons in relation to indictable matters, such as murder, manslaughter, sexual offences and drug trafficking trials and appeals

  • Appearing for prosecution and defendants in Work, Health and Safety prosecutions

  • Appeared for successful appellant in ALS v R [2015] NSWCCA 70 – verdict of acquittal on basis of unreasonable verdict

  • Appeared for partially successful appellant in NSW Court of Criminal Appeal in R v Sellar; R v McCarthy [2015] NSWCCA 76.  The case concerned the unlawful dissemination of evidence given at compulsory examination of appellant before the Australian Crime Commission

  • Appeared for successful respondent in R v Bugmy No 2 [2014] NSWCCA 322 – remitter from High Court. The case concerned social deprivation of an Aboriginal offender

  • Appeared for successful respondent in Regina v De La Rosa [2010] NSWCCA 194. Five Judge bench  in NSW Court of Criminal Appeal involving purported inconsistency between federal and State sentencing laws

  • Appeared for successful appellant in Livermore v R [2006] NSWCCA 334. Leading case on duties of prosecutor

  • Appeared for the Honourable Eric Roozendaal in an Inquiry by Independent Commission Against Corruption (ICAC) – ‘Operation Spicer’ - 2014

  • Appeared as Counsel Assisting ICAC in ‘Operation Tilga’ – investigation into corruption in security industry and public authorities - 2013

  • Appeared as Counsel Assisting in Inquest into disappearance of Belinda Peisley - 2013

  • Appeared as Counsel Assisting in Inquest into the deaths
    of Skropeta and Wyburn - 2011

    Malicious Prosecutions

  • Appeared for Commonwealth of Australia in malicious prosecution case of Commonwealth of Australia v Patrick and Elizabeth Curry

  • Appeared for Dennis Pattle in Supreme Court of NSW in successful defence against claim for malicious prosecution in Landini v State of NSW [2008] NSWSC 1280 – 2006 - 2008
