Can NSW Police lawfully search through mobile phones seized during warrantless searches? The answer is as important as it is complex. In attempting one, the paper will scrutinise local and international case law, mobile phone technology, and LEPRA. A core issue is whether the law ought recognise the increasingly stark distinction between modern mobile phones and items more traditionally found during personal searches.
